ALEXANDRIA, VA – Legislation that would impose security-related operational mandates on truck rental companies is pending consideration in the New York Senate, according to the Trucking Renting and Leasing Association (TRALA). The bill, SB 4495, was originally introduced in May 2005 by Senator Michael Balboni (R-East Williston). The bill was recently amended and reintroduced to reflect changes in the law since its initial introduction. Senator Balboni is the Chairman of the Senate Committee on Veterans, Homeland Security, and Military Affairs. The timing for consideration of SB 4495 is still uncertain. The pending bill would require companies renting vans, trucks, or trailers to 1) register with the state, 2) maintain records for two years, 3) require a drivers’ license and one additional form of identification from all customers, 4) make meaningful assurances to verify customers’ identification, and 5) disclose on rental agreements the possibility that customers’ names may be checked against terrorist watch lists. SB 4495 would also require the NY Office of Homeland Security to develop and promote best practices for truck rental companies operating in New York. According to TRALA, it remains concerned about legislation that would impose a state-by-state patchwork of varying security standards and mandates on the interstate operations of truck renting and leasing companies. TRALA has contacted Senator Balboni and shared with his office the actions already taken by the industry in cooperation with the federal government. These actions include the publication and distribution of Safeguarding America’s Transportation System — A Security Guide for Truck Rental Company Employees and the Truck Renting and Leasing Security Awareness and Self-Assessment Guide. TRALA said it will continue to work with Senator Balboni’s office as SB 4495 is under consideration.
