A district court judge dismissed Rhino Linings from a class action suit seeking damages from truck bed lining manufacturers based on allegations the liners caused fire dangers. Rhino Linings produces sprayed-on polyurethane linings that permanently protect vehicles, industrial equipment, manufactured components, and manufacturing facilities from corrosion, abrasion, impact, and chemicals. The other drop-in liner companies named in the suit settled out of court, but Rhino Linings commissioned and submitted research that proved its product increases truck safety compared to the original equipment. The lawsuit, Jimmy Brown, et al. vs. Durakon Industries Inc. et al., was filed in November 1996 against manufacturers of truck bed liners. The lawsuit alleges that fires can result from the buildup of static electricity. The insulating effect of the truck bed liner prevents grounding of the static charge generated by gasoline flowing into a plastic or metal container placed on the bed liner. When the static buildup is discharged to a grounded gasoline dispenser nozzle, a spark may result, which could ignite the gasoline. Rhino Linings is made of different material than the other liners mentioned in the lawsuit, so the danger of explosion does not apply. In tests conducted by Lev Isaac Berger, chief executive officer of the California Institute of Electronics and Material Sciences, Rhino Linings exhibited lower resistivity and better static charge dissipation characteristics. Following the ruling, Rhino Linings will not be required to place a warning label on its product.
