ISELIN, NJ — The hours-of-service final rule published on Aug. 25, becomes effective on Oct. 1. However, the Federal Motor Carrier Safety Administration (FMCSA) recognizes that neither fleets nor enforcement agencies will be able to implement every provision of the new hours-of-service regulations immediately. Therefore, FMCSA will provide a transition period for compliance and enforcement from Oct. 1 through Dec. 31. During this transitional period, FMCSA will monitor carriers for egregious violations of the new hours-of-service rule and pursue enforcement action when necessary. Egregious violations are those that show a clear disregard for safety by the motor carrier or operator. FMCSA strongly encourages state enforcement authorities to show comparable enforcement discretion.
