SPRINGFIELD, IL – A TRALA-sponsored amendment to exempt truck lessors from liability for diesel engine idling violations committed by customers was adopted by the Illinois State Senate on May 19, 2005. The TRALA amendment was made to House Bill 2347, a bill to establish idling restrictions on vehicles with a GVWR of more than 8,000 lbs. As introduced, the bill would have held the vehicle owner liable for idling violations. TRALA worked with the bill sponsor, Representative Elaine Nekritz (D-Des Plaines), to draft the amendment that would make the vehicle operator liable for idling violations. TRALA is working through the U.S. EPA's Smartway Program to develop similar protections for lessors in other states. TRALA's intent is to include language in draft model legislation that addresses the lessor/lessee idling issue. For more information on the Illinois bill or the draft model legislation, please contact TRALA's John Lynch at 703-299-9120 or jlynch@trala.org.
