Video: Mass. Considers Hands-Free Phone Legislation

The Massachusetts Senate on Jan. 21 is expected to begin debating proposed legislation that would ban handheld cell phone use while driving.

The bill seeks to prohibit the use of any mobile electronic device while operating a vehicle, unless the driver operates the device hands-free.

A first offense would carry a $100 fine, and a second violation would cost $250. Third and subsequent violations would each carry a $500 fine.

A driver who makes a phone call to report an emergency might qualify for exemption.

A texting-while-driving ban has been in effect in Massachusetts since 2010. Additionally, drivers under 18 are already prohibited from using a cell phone while driving.

State Senator Mark Montigny, who has long pushed for a hands-free phone law in the commonwealth, introduced the bill.

    We need to turn MADD on the states. Who has to be killed the president's daughters to get this through peoples heads. Sorry but the local paper did a survey just by standing on the side of the road at 6 different locations. This was supposed to be a 3 hour event and after 10 minutes they gave up because almost everyone was on their phones. If you ask any driver of a high profile vehicle or truck they will tell you the same thing. I propose that I will drive my motor home and my wife will photo graph every driver who is on the phone. This will include the tag number and the face of the driver. Turn over the evidence to the state police. I want 50% of the fines collected! Some cities have even sat on the side of the road with what look like panhandlers with signs saying that they are looking for people that are on cells. this hasn't stopped them.
