Toyota Attorneys Move to Dismiss Lawsuits
SANTA ANA, CA - Toyota Motor Corp. attorneys on Tuesday, Sept. 14, filed motions in federal court to dismiss a number of lawsuits seeking class-action status, according to a City News Service report.
The motions included assertions that the plaintiffs have failed to support their claims that Toyota's vehicles have electronic problems that led to sudden and unintended acceleration.
"Plaintiffs conclude without support that the Toyota vehicles are defectively designed or manufactured and inherently dangerous and have a propensity to suddenly accelerate, lose control and cause injuries," stated a motion to dismiss.
In addition, the motion adds: "Plaintiffs fail to allege facts that place their negligence and product defect claims across the line from conceivable to plausible."
