Lessors Exempt From Mich. Diesel Engine Idling Restriction Initiative
LANSING, MI – Legislation introduced in the Michigan Senate to limit diesel engine idling includes a Truck Renting and Leasing Association (TRALA) supported provision that exempts lessors from liability for customer idling violations. Senate Bill 1402, sponsored by Sen. Raymond Bashem and assigned to the Senate Transportation Committee, would establish a program in which no diesel-powered vehicle greater than 8,000 lbs. can idle stationary longer than 10 minutes in a non-attainment area; defined as a county which exceeds the ozone and particulate matter levels permitted under federal law.Michigan SB 1402 is modeled after the Ill. diesel engine idling legislation, House Bill 4782, signed into law by Gov. Rod Blagojevich June 9, 2006. Prior to its enactment, TRALA successfully amended the Illinois idling proposal to include a truck lessor liability exemption. The lessor exemption in SB 1402 uses the same language pushed by TRALA successfully in Illinois.
